• Davina’s Law: Reforming CPS and Family Court for Vulnerable Families

    Davina’s Law is a developing legislative initiative created to protect families from wrongful separation—especially when dealing with medically complex children. Inspired by Davina Joy-Janette’s story, this law seeks to bring transparency, accountability, and fairness into the CPS and family court systems.

    A key goal of Davina’s Law is to reform how Leave to Proceed motions are granted. We believe no parent should be given legal power over a child unless they can prove they are actively providing daily care, not just seeking control. The proposed law would require the requesting parent to meet certain standards, including demonstrated caregiving involvement, mental health readiness, and a clear absence of intent to alienate the other parent.

    Additionally, Davina’s Law aims to prevent open but unfounded CPS cases from being weaponized in family court, ensuring that accusations without merit cannot be used to strip a parent of their rights.

    This law is still in progress, with room to grow through the voices of families who have lived it. Together, we are building protections that prioritize truth over assumption, children over power struggles, and justice over fear.
